 BY-LAWS

The By-Laws of the Wembley Wackers Golf Club 1954 Incorporated are written under the authority of Clause 55 of the Club Constitution which states:

The Top Table shall make and amend such By-Laws as may be necessary for the management, control and good order of the Club and for Top Table proceedings provided that no By-Laws shall be inconsistent with the Constitution. By-Laws bind all Members on and from the date of notification on the Club Notice Board.

1 TOP TABLE & MANAGEMENT

1.1 Ownership and Management of the Club

The Club facilities are owned by the Wembley Whackers Golf Club 1954 Incorporated and are made available to the Club for the purposes described in these By-Laws and the Constitution. The Top Table exercises such powers as are prescribed in the Constitution and these By-Laws to manage and control the business and finances of the Club.

1.2 Committees

A member of the Top Table shall be appointed to Chair a Standing Committee. Prospective members of the Committees can be nominated by the Chair of each Committee but are to be approved and endorsed by the Top Table. The role of the Committees is as broadly set out below and as defined and detailed in the Terms of Reference for each Committee

1.2.1 Finance Committee

The Finance Committee shall consist of a Chairman plus Club Members as shall be nominated by the Chairman and endorsed by the Top Table.

Role of the Finance Committee

To advise and assist the Secretary/Treasurer in the conduct of their responsibilities as detailed in the Constitution. This includes preparing and analysing budgets, cash flow projections and other financial reports and providing guidance and recommendations on any financial matters as requested from time to time by the Top Table.

1.2.2 Other Committees

The Top Table may form a Committee for whatever purposes are deemed appropriate by the Top Table. The Chair of the Committee and Committee Members will be determined by the Top Table. The role of the Committee shall be determined by the Top Table through provision of a Terms of Reference document.

1.2.3 Terms of Reference

Each Committee shall operate within a documented and agreed Terms of Reference as approved by the Top Table. This Terms of Reference outlines the authority, responsibility and reporting relationship of the Committee and ensures each Committee operates in line with the strategic direction of the Top Table.

1.3 Election & Appointment

Top Table members are elected by the Members as per the constitution.

The standing Committees of Golf and Finance are formed each year after Club elections.

A Top Table Member is designated to Chair each Committee and form these Committees from the membership base. The composition of the Committees is as nominated by the Chair of each Committee and as approved and endorsed by the Top Table.

1.4 Organisational Structure & Reporting

The Top Table reports to the Members.  

The Committees advise, assist and report to the Top Table and undertake such activities as directed and requested by the Top Table.

1.5 Meetings

The Top Table minutes are to be documented and retained on file and made available for all members to review. The Top Table will also publish the minutes of the meeting on the Club website within 14 days of the following Top Table meeting.

1.6 Bank Signatories

Top Table Members are required to authorise any payment or bank transaction. The following positions are authorised as signatories for such purposes:

  • • President
  • • Vice President
  • • Club Captain
  • • Secretary/Treasurer

2 Membership

2.1 New Members

It was agreed that Membership to the WWGC may be accepted as required.

Following nomination by a full paid Financial Member the Male applicant must play a minimum of three games with a member of the committee, prior to a vote of acceptance by a regular meeting of the club.

Club Membership is to be limited to 50 Members.

A Vote or acceptance of a new member must be by a show of hands. Minimum YES vote is to be no less than 51% of the Members present at the regular Meeting. No PROXY vote for membership.

A New Member will receive a Club Handicap after submitting the three cards from the games he has played with the Member of the Committee.

Prior to establishment of his Club Handicap the maximum handicap he may play on is 18. The maximum is to be at the discretion of the Handicapper

Visitors

Members must advise the President and/or Club Captain that they are inviting a visitor to play.

A visitor cannot win the DAY or MAJOR trophy and should be encouraged to stay after play for the Trophy presentation.

2.2 Code of Conduct – Behaviour & Discipline

The Members Code of Conduct applies equally to members and their guests, including visiting players from other clubs for sporting competitions and social functions.

On the course:

i. Players must display respect to their team mates and opponents, play the game within the rules of golf and golf etiquette and observe the conditions of play for the day. Golf is to be played with the highest degree of sportsmanship and honesty.

ii. Players will not engage in offensive language, dissent, conduct unbecoming, or actions which would bring the game of golf or the club into disrepute.

iii. Members, family and guests will respect other patrons and will conduct themselves in a manner that will not cause offence.

iv. Abusive or offensive language is not permitted within the clubhouse or surrounds.

v. Members, family and guests, when consuming alcohol, will do so responsibly, and will accept any staff or licensee decision to amend behaviour or discontinue the serving of alcohol without complaint.

2.3 Players Risk

• A player or visitor playing with the Wembley Whackers does so at the player’s own risk.

The Club will not be liable for any loss of or damage to the property of any player or visitor while the player or visitor is playing.

 Each member, player or visitor indemnifies the Club, including its officers against loss of or damage to any person or property caused by the Member, player or visitor while playing

  CLUB RULES

3.1 Rules

The Members of the Club agreed to adopt the Australian Handicapping System as at the 1/1/1976, and to continue with the current A.G.U. System.

3.2 Playing Day

All WHACKERS Events are to be played on a Thursday except under the direction of the Committee

3.3 Hit off Time

Between 1130am – Noon except under the direction of the Committee

3.4 Preferred Lie

A Preferred Lie permitted to 15 cm on the Green and one Club length on the Fairway.

3.5 Ball

If agreed by the Players that a Ball in Play has been removed by an outside agency from the Fairway, then the Player is permitted to drop a Ball at the estimated position for no penalty.

3.6 Nearest the Pin

This competition is to be played on two of the Par 3 holes each week. The club is to provide a ball for the winner

3.7 Jackpot

The winner of the jackpot is entitled to all the money in the Jackpot including any carryover. In the event of there being more than one Winner, then they shall share all the money in the jackpot and carryover. The Jackpot can only be won on the green opposite to the “nearest the pin”.

3.8 Gimmees

At a General Meeting of the Members it was agreed by a majority that “Gimmees” be NOT ALLOWED in any game played by the Whackers.

3.9 Marker Stakes

Fairway marker stakes are to be treated the same way as staked trees. Relief – one club length not nearer the hole.

3.10 Cut of the Cards

In a cut of the cards for the winner, the ties cut and all others drop out. No two tie all tie.

18th June 1998, moved B Smedley, seconded D Anza, when a ball lands in a hazard and is not plugged it may be lifted and placed … carried.

3.11 Sand Trap

When a Ball comes to rest in a sand trap in a footmark or other unplayable position caused by non raking of the Bunker, then the opposing player must rake the sand and replace the ball in the same position no penalty.

3.12 Green Keepers Hazard

The Sump Hole on the right of the 11th Fairway is declared a green keepers hazard, allowing the player to take relief backwards out of the sump. The pump shed on the left of the 4th fairway and the pump on the right of the 8th fairway are also Green Keepers Hazards.

3.13 Eclectic

The committee is to arrange the Eclectic Results in two groups – 15 and under – 16 and over. Annually

3.14 18th Hole

The 18th fairway is to be played as laid out, no intentional short cut up the 10th fairway.

3.15 Deciding Ties in Events

Ties in events shall be decided whenever possible by replay, but if the Committee considers this to be inexpedient the following count—back method shall be used.

  1. For 18hole events the best score for the last 9 holes shall be used. If there is still a Tie

 (Total for) the last 6 holes or if still tied the last 3 holes. If a Tie still persists then hole by hole from the 18th.

  • In 27, 36, 54, and 72hole events the last 18 holes shall be used and if still tied count—back as in 1 above.
  • In handicap events the relevant handicap or the fraction thereof shall be applied.
  • Where a penalty applicable under Rule 3.5 of the Rules of Golf is applied to a result this penalty shall be ignored so far as the count-back is concerned.

Note: For a 9 hole event the best score for the last 6 holes shall be used, if there is still a Tie the last 3 holes, if a Tie still persists then hole by hole from the 9th Hole  . (January 1985)

3.16 Count Back

Count—Back on ordinary Events. The Winner receives the Trophy and the Runner up gets two Balls.

3.17 Winning Trophies

During the Winter Season the Players can win the, WHACKERS CUP, WHACKERS MEMORIAL, PRESIDENTS TROPHY, PATRONS TROPHY, CAPTAINS TROPHY and no more than three other events. After winning the three ordinary events, the player is not eligible to win a fourth, but wins two balls for the future wins.

3.18 Trophy Donnors

The President is to call, on the second meeting for the year for members who wish to donate a trophy for the Winners of the events of the season. Apart from Members of the Club, a donor can be a person or a Business who is allied with the Club, ie The Golf Pros or the Tavern Owners etc. The Secretary is to advise the donor two weeks before his trophy is to be presented. The value of each trophy is to be not less than $100.00 and not in cash.

Each trophy day will be designated to a member (financial or not) to donate a trophy of value no less than $100 and to be in the Spirit of the Whackers in nature.

4 The Whackers Cup

The Whackers Cup is an event to be played as stroke on the last three fixture days of the season.

The Whackers Cup is to be held by the winner for 12 months only. The club will purchase a replica or similar to be held in perpetuity. The club will also purchase a prize for the winner.

Eligibility to Play

No new members are eligible to win the Whackers Cup in their first year with the club.

Handicap

The maximum handicap for this event shall be no more than 27

No Play Prior to this Event

No Whacker is to play on the Wembley Golf Course on this day prior to the event.

Dead Heat

In the event of a tie the winner will be decided on the last day of the cup with a sudden death play off down the tenth and up the eighteenth hole based on handicap.

First Second and Third Days

If the winner of the Day Trophy has already won three trophies for the season, then he is to win the runner up trophy.

5 Whackers Memorial Cup

The WHACKERS MEMORIAL TROPHY is an event to be played as stroke over two days.      The MEMORIAL TROPHY is to be held for 12 months only. The Club will purchase a replica or similar, to be held in perpetuity. The Club will also purchase a prize for the winner

Eligibility to Play

No new members are eligible to win the Whackers Cup in their first year with the club.

Handicap

The maximum handicap for this event shall be no more than 27

No Play Prior to this Event

No Whacker is to play on the Wembley Golf Course on this day prior to the event.

Dead Heat

In the event of a tie the winner will be decided on the last day of the cup with a sudden death playoff down the tenth and up the eighteenth hole based on handicap.

First Second and Third Days

If the winner of the Day Trophy has already won three trophies for the season, then he is to win the runner up trophy.

6 Summer Competition

The Vice-Captain will organise the competition and be assisted by a person of his choice.

The competition will be a sweepstake and the distribution of prize money will be to first and second place getters only.

The first day of the competition shall be held on the week after the Winter Season.

Members will need to have played on at least five days prior to that date to win the SUMMER CUP.

7 Summer Cup 

The SUMMER CUP shall be held two weeks before the opening of the Winter Season.

In the event of a tie in the CUP EVENT the result will be determined by a “Sudden Death” play off starting on the 10th hole of the old course. If a result is not arrived at after playing the 10th then the contenders will move to the 18th Hole. Should a result not be achieved then the 10th and 18th will be played until a result is gained.

Members will need to have played on at least five days prior to that date to win the SUMMER CUP.

Handicaps will be adjusted during the summer   accordance with the methods applied during the winter Season.

8 Equipment

Each player must have a golf bag and a set of clubs. Two or more players must not play out of the same bag or otherwise, with a single set of clubs.

9 Pace of Play

Players should play in accordance with Club expectations on the pace of play and at a pace that enables them to be as close as practical to the group in front without danger of hitting up nor creating undue pressure.

10 Etiquette

Customary golf course etiquette shall be observed at all times.

Players should not disturb the play of others by moving, talking or making a noise especially when in close proximity to tees and greens.

Players should not stand close to or directly behind the ball or the hole, nor unreasonably close to the forward line of play, when another is about to play.

On the putting green, players should not stand on, nor cast a shadow over another player’s line of putt.

It is every player’s responsibility to ensure that the etiquette of the game is observed.
